Health board accused of withholding documents in employment tribunal

An employment tribunal has been suspended for a week after NHS Fife was accused of withholding documents.

Nurse Sandie Peggie has taken the board to tribunal after she was suspended following allegations of harassment and bullying against transgender doctor, Dr Beth Upton, who had been using the female changing rooms at Victoria Hospital in Kirkcaldy.

The nurse's lawyer Naomi Cunningham has demanded to see the documentation relating to an investigation of Ms Peggie before the trial resumes.

Ms Peggie was suspended in January 2024 after she had an altercation in the changing room with Dr Upton on 24 December 2023.

Ms Peggie has told the tribunal she felt she felt ‘embarrassed and intimidated' when Dr Upton started getting changed in the room.

An NHS Fife spokesperson said: ‘NHS Fife considers it inappropriate to comment during the employment tribunal. It is important to recognise that at the heart of this case are two employees, who should be treated with kindness and respect.

‘As an organisation, NHS Fife remains committed to upholding its duty of care to all employees.'
